“While the nation fretted over the ouster of one Duckster from the parallel reality of a TV reality show, more of the protections enshrined in the Fourth Amendment of the U.S. Constitution evaporated.

Just after Christmas, district-court Judge William Pauley ruled that the privacy protections afforded by the Constitution were relative freedoms, not absolutes ones. As such, Fourth-Amendment rights had to be calibrated against a government’s need to maintain a database of records that would (putatively) prevent future terrorist attacks. …

… This is the inglorious history of American freedom and federalism. In the rare event that the Supreme Court refuses to play along (as nicely as plaything Justice John G. Roberts did for ObamaCare)—there is always a perfectly legal, extra-constitutional, quasi-legislative, quasi-executive, quasi-judicial, “independent” regulatory commission or executive agency to kill off or override constitutional protections.

A “civil liberties officer,” for example.

The nice men in periwigs who came up with the Fourth Amendment were recklessly naive to imagine that branches of a government, each of whose power is enhanced when the power of the other branches grows, would serve to check one another. The idea of a judiciary that would police the executive as an arm of a self-correcting tripartite government was worse than naive.

As “luck” would have it, legislation that flouts the Fourth Amendment was previously in place to provide Pauley with all the positive-law backing the judge needed to justify an anti-constitutional ruling. To wit, the grounds upon which the New York jurist dismissed this ACLU (American Civil Liberties Union) case against the NSA were, primarily, “that bulk collection was [already] authorized under existing laws allowing ‘relevant’ data collection to be authorized by secret US courts.”

Here you have the essence of modern-day, Managerial-State America. Natural law, common-law and Constitution have been nullified; buried under the rubble of legislation, statute, precedent, ad infinitum, rights having long-since been outsourced to the “better” judgment of bureaucrats and hired “experts.”

Mercer lost me. Was a fan. Now her libertarian squeamish mish-mash of words only offend me. Her article on hunting cut the cord. I, as a conservative libertarian only have this response. You cannot chastise Ilana for your lack of command of the national language of the USA. She uses no words not from a good dictionary – the only “mish-mash” is the pancake between your ears.

As far as being ‘offended’ – kindly consider carefully what is ostensibly ‘arrogance’ and what is de facto personal insecurities.

UPDATED: Chucky Krauthammer’s Keynesianism (Neocon Chucky: Tinkering Technocrat)

On Special Report today, Chucky Krauthammer could be heard quickly correcting his characteristic Keynesianism when fellow Fox-News panelist neoconservative George Will made him look, well, silly. As she knows nothing about economics, the blond Kirsten Powers, also empaneled to discuss the economy, was none the wiser. Neither did host Bret Baier notice Chucky stumble and recover.

The Fed had set the price of money at zero, Krauthammer noodled. In his opinion, this served as a positive impetus for steady but slow economic growth. The far cleverer George Will jumped on this, pointing out that quantitative easing was the Democratic equivalent of faux trickle-down economics. In other words, the manufacturing of paper money inflates prices on the stock exchange, enriches a few big players, and leaves the rest of us holding devalued dollars and struggling to survive. (Naturally, this is not verbatim. I paraphrase from memory, since few news outlets bother with the written word any longer.)

Like greased lightening, Krauthammer leaped to finesse his Fed demand-creation Keynesianism.

As mentioned, other than the two men involved, nobody (except a few Austrians like myself) noticed.

UPDATE (1/3): EPJ on Chucky’s Nutty Two Tier Minimum Wage Proposal. Our neocon is such a tinkering technocrat.

This is truly goofy. It would result in businesses hiring teenagers over breadwinners. Since the advocate Charles Krauthammer seems to understand that raising the minimum wage causes unemployment, his proposal has to be classified as pathological altruism.

On a Fox News panel earlier this week, Charles Krauthammer floated a proposal for a two-tiered minimum wage system in which the rate would be raised for individuals who are the breadwinners of their families and remain the same for others. But this would be an absolutely terrible idea.

The No-Good Obama Has Altered American Medicine For Good

Dr. Ramin Oskoui spoke extremely knowledgeably, on the Laura Ingraham Show, about the precise connection between curtailed medical care and ObamaCare. These are a few of the many ways in which the creep-in-chief’s signature legislation will degrade American medicine:

* Cancer: The concept of personalized medical care and the use of specific, state-of-the-art drugs that work with the individual’s genetic make-up—these will diminish considerably. ObamaCare puts access to “crucial medical progress at great risk.”

* PET scans, for example, will be limited to three in a lifetime, although cancer patients often have that many during initial diagnosis.

ObamaCare aims to control costs, explained Dr. Oskoui. For cancer patients this is achieved by blocking the patient’s ability to seek out specialized doctors. Because insurance provides cannot adjust premiums and benefits, the only thing they can do to control costs is to limit access and care—they must limit the network of providers with which they contract.

Bundle payments: doctors get lump sums of money to care for patients with particular conditions. This coerces them to cut down on the use of costlier, newer drugs and tests. It also pits what the doctor earns for caring for these patients against his payment, reducing his incentives to offer the best of remedies if these are more costly.

After all, doctors in private practice are small businessmen. They cannot provide a service for less than it costs them to provide.

Even if ObamaCare collapses under its own weight, warns Dr. Oskoui, it has “already changed the medical landscape.” Many specialists have migrated to the hospital system because, as “favored providers,” hospital-based medics are allowed to bill more than they would when working for themselves.

Both the host and this intelligent cardiac surgeon have concluded that ObamaCare is not about the practice of medicine, but about wealth distribution.

It is a tax bill.

“The entire medical landscape,” observed Ms. Ingraham, “has shifted to help the few who didn’t want healthcare or couldn’t afford it. (A point made back in 2009 in “Destroying Healthcare For The Few Uninsured.”)

Dr. Oskoui: ObamaCare has transferred financial risk to the providers of healthcare and away from Big Pharma, the insurers, those receiving healthcare. The latter, and the electronic health-records manufacturers, profit.

Again: it’s a wealth-transfer program; an entitlement program.

UPDATE II: Common-Core Curriculum: ‘Fascism With A Smile’ (‘Soft Despotism’)

The centralization of education has allowed public “intellectuals” and “experts” to mold and manacle young minds. Start a conversation with almost anyone on the street. Provided he speaks English, you’ll hear within a whisker the same opinions repeated on capitalism (plain evil or a necessary evil), the environment (near destruction) and racism (rife). This uniformity of opinion is almost scarier than its uninformed nature.

At EPJ, the best libertarian site on the WWW, John Whitehead, author of “A Government of Wolves: The Emerging American Police State,” warns about the latest federal ploy to “transform and nationalize school curriculum from kindergarten through 12th grade”:

… there are several methods for controlling a population. You can intimidate the citizenry into obedience through force, relying on military strength and weaponry such as SWAT team raids, militarized police, and a vast array of lethal and nonlethal weapons. You can manipulate them into marching in lockstep with your dictates through the use of propaganda and carefully timed fear tactics about threats to their safety, whether through the phantom menace of terrorist attacks or shooting sprees by solitary gunmen. Or you can indoctrinate them into compliance from an early age through the schools, discouraging them from thinking for themselves while rewarding them for regurgitating whatever the government, through its so-called educational standards, dictates they should be taught.

Those who founded America believed that an educated citizenry knowledgeable about their rights was the surest means of preserving freedom. If so, then the inverse should also hold true: that the surest way for a government to maintain its power and keep the citizenry in line is by rendering them ignorant of their rights and unable to think for themselves.

When viewed in light of the government’s ongoing attempts to amass power at great cost to Americans—in terms of free speech rights, privacy, due process, etc.—the debate over Common Core State Standards, which would transform and nationalize school curriculum from kindergarten through 12th grade, becomes that much more critical.

Essentially, these standards, which were developed through a partnership between big government and corporations, in the absence of any real input from parents or educators with practical, hands-on classroom experience, and are being rolled out in 45 states and the District of Columbia, will create a generation of test-takers capable of little else, molded and shaped by the federal government and its corporate allies into what it considers to be ideal citizens. …

UPDATE I: Parent Arrested For Questioning Pedagogues.

John Whitehead:

…46-year-old Robert Small, found himself “pulled out of the meeting, arrested and charged with second-degree assault of a police officer” simply for daring to voice his discontent with the standards during a Q&A session with the superintendent.

Even calling this event a forum is disingenuous, given that attendees were not allowed to stand and ask questions. Instead, attendees were instructed to write their questions on a piece of paper, which the superintendent would then read and members of a panel would answer. In other words, there would be no time or room for debate, just a one-sided discussion. And this is what life in our so-called republic of the United States has been reduced to, a one-sided monologue by government officials who neither care about what “we the people” have to say, nor are they inclined to hear us out, just so long as we pay their taxes and abide by their laws.

“Don’t stand for this. You are sitting here like cattle,” shouted Robert Small to his fellow attendees as he was being dragged out of the “forum” on the Common Core standards. “Is this America?” No, Mr. Small, this is no longer America.

UPDATE II (9/24): SERVANTS OF THE POLITICAL CLASS. Former polster Pat Caddell is able to get to the crux of the arrest and attempted prosecution of a parent for questioning the pedagogues.

“What we saw here is bigger than just this. The people are the slaves to the office-holders: superintendents who won’t take questions, the EPA that goes to Alaska on to conduct a … raid, SWAT converging with guns on a gold-mining operation in a little town; the things that government does now to oppress people; the laws that we have, the NSA, the fear people have of the state spying on them and imposing on them–this is a kind of soft despotism, whereby if you get out of line, we’ll get you. We work for them. Public servants are the masters; we are the servants of the political class.”
