UPDATED: The Despot’s Bag of Tricks

In apartheid South Africa, denial of due process very often took the form of detention without trial. But, as I observed in Into the Cannibal’s Pot: Lessons for America from Post-Apartheid South Africa, the South-African model of detention-without-trial is slowly becoming a fixture of the American legal landscape.

Via the Tenth Amendment Center:

Congress just passed, and the President just signed, a bill that gives legal authority to the President to kidnap and perpetually imprison persons, including American citizens, without the benefit of due process. …

The relevant sections of the bill are 1021 and 1022.

* Section 1021 asserts the President’s authority to arrest suspected (not convicted) terrorists and gives him the option to choose whether or not they even get a trial, and if so, what kind of trial.

* Section 1022 requires that a certain class of terrorist get no trial. Instead they must be held in military prisons, for as long as this President, or any future President desires.

SECTION 1021

Section 1021 is very expansive in its reach. It “includ[es] any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.”

* Who is “any person?”
* What is a “belligerent act?”
* What is “direct support?”

One could be safe in assuming these words mean whatever a creatively-minded prosecutor, a flexible judge, and an ignorant jury define them to mean — EXCEPT THAT, UNDER THIS ACT, ONE MIGHT NEVER GET AS FAR AS A COURT HEARING.

These terms will be defined by the bureaucrats in power.

Note who the bill’s co-sponsor is: McMussolini.

UPDATE: RT: “He will forever be known as the president who signed indefinite detention without charge or trial into law.”

These harsh words come courtesy of the executive director of the ACLU, formerly a supporter of the president but also just one of the many dissenters who have since grown disillusioned with an administration tarnished by unfulfilled campaign promises and continuous constitutional violations.

Tea Party Congress has Failed to Tackle TSA Terrorism

Homeland Security, Justice, Regulation, Terrorism

Lenore Zimmerman is defiant and articulate. Would that individuals like her replaced the Occupy Wall Street Idiocracy. The “85-year-old Long Island grandmother” is the latest victim of the homegrown terrorists of the TSA. She might be tiny and fragile, but unlike so many other TSA “victims,” Lenore is not weepy or weak:

Lenore … says she was on her way to a 1 p.m. flight to Fort Lauderdale when security whisked her to a private room and took off her clothes.
“I walk with a walker — I really look like a terrorist,” she said sarcastically. “I’m tiny. I weigh 110 pounds, 107 without clothes, and I was strip-searched.”
TSA spokeswoman Lisa Farbstein said a review of closed circuit TV footage from the airport shows “proper procedures were followed.”
But Zimmerman, whose hunched back puts her at 4-foot-11, said her ordeal began after her son, Bruce, drove her to the JetBlue terminal for the Florida flight. She lives in warm Coconut Creek during the winter.
She checked her bags, waited for a wheelchair and parted ways with her doting son — her only immediate relative.
When Zimmerman reached a security checkpoint, she asked if she could forgo the advanced image technology screening equipment, fearing it might interfere with her defibrillator.
She said she normally gets patted down. But this time, she says that two female agents escorted her to a private room and began to remove her clothes.
“I was outraged,” said Zimmerman, a retired receptionist.
As she tried to lift a lightweight walker off her lap, she says, the metal bars banged against her leg and blood trickled from a gash.
“My sock was soaked with blood,” she said. “I was bleeding like a pig.”
She says the TSA agents showed no sympathy, instead pulling down her pants and asking her to raise her arms.

These TSA legalized assaults happen daily in police state USA. The triumphant Republican majority in Congress claims to have a new-found affinity for freedom. If this were so, their first order of business would have been to stop the molestation en masse at the country’s airports. So far nothing has been done about the ongoing violations of the individual’s constitutional right to be free of unreasonable searches without probable cause.

Face it, the Republican Party’s fidelity is to the security state, not to liberty.

Freak Street

The freaks of the Occupy Wall Street (bowel) movement make it plain that they want what Charles Payne of the Fox Business Network has worked so hard to attain. Their case? That Payne, who began his business in a Harlem basement apartment, with monies borrowed from family and friends, owes his success to the rabble and its willing sponsor, government.

Yes, statists and their prized sponsors—moochers and looters—like to claim that if not for the state, to whose coffers they hardly contribute—man would be unable to produce.

That’s like saying that the tick created the dog! Production predates government predation. Government doesn’t produce wealth—it only consumes it. What, pray tell, would government have fed off if people were not hard at work well before the advent of the bureaucracy? As usual, the statists have it topsy-turvy. First came the individual—he is the basic unit of society, without which there can be no society. And without man’s labor there is no wealth for government to siphon.

Meet two more good Americans: Derek and John Tabacco, proprietors of a small business on Wall Street. The two businessmen staged a counter-protest against the Occupiers, holding up neon green signs that read “Occupy a Desk!“ and ”Get a Job.”

“We got a bunch of small business owners together…and we thought that ‘hey, any good occupation couldn’t be ended without some resistance,’” John told Fox News, adding that there was a coalition of about 50 small business owners who are part of his movement.
“They were coming after us , they were screaming at us, trying to get in our face, putting their hands on us,” he said. He also identified with the “53%” — the group that pays taxes that the other 47% doesn’t — and said the “silent majority” was giving them the thumbs up during their counter-protest.

Predictably, the slimy Salon.com tries to discredit the Tabacco brothers’ case for industry and work by discrediting them.

The Mind of a Pederast

On the one hand, Gerald A. Sandusky, the alleged perpetrator in the Penn State football sexual abuse scandal, did a lot of good. He founded The Second Mile program, which was designed to help boys from troubled backgrounds. The charity’s chapters have now sprung up across the commonwealth. Sandusky was “the primary fund raiser” for Second Mile. He raised millions for this good cause—but he also likely sexually abused at least 8 recipients of his charity, if not many more.

Yes, the Grand Jury’s Findings of Fact are quite damning, as there is ample corroborating evidence provided by witnesses other than Sandusky’s victims, as well as phone records chronicling Sandusky’s obsessive preoccupation with this or the other victim. (Sixty phone calls to a teenage boy?) There were expensive gifts as well. When the mother of victim #six complained to University Police after her boy was returned home hair wet from showering with Sandusky, the investigation was abruptly terminated.

In a conversation with that mom (recorded by police), Sandusky said he wished he were dead. A very twisted and tormented man is this. A married man, no less. A little less hysteria and a lot more factual reporting in the media, and you’d learn that Sandusky is indeed married and has adopted children. My, my, what an intricate web he wove and what a generous helping hand he got from the authorities.

The worst testimony comes from a 28-year-old “graduate assistant” who witnessed Sandusky in the locker room’s showers having sex with a boy aged ten! This incident was never reported to the police, university and other. The victim was not identified.

Nevertheless, as bad as the evidence appears to be, let the man have his day in a court of law.
